NPA secures preservation orders over R7.2m assets linked to alleged illegal mining

The National Prosecuting Authority's Asset Forfeiture Unit (AFU) in Mahikeng has secured three preservation orders over assets worth more than R7.2 million allegedly linked to illegal mining activities in the North West.

The orders were obtained in collaboration with the South African Police Service and the Directorate for Priority Crime Investigation, known as the Hawks.

The first order covers four excavators and a dump truck worth about R4.27 million, seized at Hencor Mining in Kroondal, Rustenburg, on 4 August during a joint operation.

The NPA said the mining authorisation for the premises had expired, while information indicated that mining activities allegedly continued. The criminal investigation is ongoing.

A second order relates to three trucks and trailers valued at about R2.67 million. They were intercepted at Bapong Oustad near Mooinooi on 1 January while allegedly transporting chrome-bearing ore.

The drivers could not provide documentation authorising the mining and transportation of the material. Four accused were subsequently convicted after pleading guilty on 9 June.

The third order covers a Toyota Hilux valued at about R265,000, which was stopped near Stilfontein on the N12 in November 2025. Two bags containing gold-bearing material were allegedly found inside the vehicle.

The NPA said the assets were preserved because they are alleged to be proceeds of unlawful activities or instrumentalities of offences listed under Schedule 1 of the Prevention of Organised Crime Act.

North West Director of Public Prosecutions Dr Rachel Makhari said the orders demonstrated the NPA's focus on targeting financial gains allegedly derived from criminal activity.
